Thai Massage

Known in Thailand as (Nuat phaen boran), meaning "ancient/traditional massage", Thai massage is also known as Thai ancient massage, traditional Thai massage, Thai yoga massage, yoga massage, Thai classical massage, Thai bodywork, passive yoga or assisted yoga.

The massage recipient changes into loose, comfortable clothes and lies on a mat or firm mattress on the floor. (It can be done solo or in a group of a dozen or so patients in the same large room.) The massage practitioner leans on the recipient's body using hands and usually straight forearms locked at the elbow to apply firm rhythmic pressure. The massage generally follows the Sen lines on the body — somewhat analogous to meridians or Channel (Chinese medicine) and Indian nadis. Legs and feet of the giver can be used to fixate the body or limbs of the recipient. In other styles, hands fixate the body, while the feet do the massaging action. Oil is not used in traditional Thai Massage. A full Thai massage session typically lasts two hours or more, and includes rhythmic pressing and stretching of the entire body; this may include pulling fingers, toes, ears, cracking the knuckles, walking on the recipient's back, and arching the recipient's into bhujangasana or (cobra position). There is a standard procedure and rhythm to this massage. In Thailand a two hour massage might cost around 300 Thai baht (about $10 Canadian) depending on location (it may cost ten times more inside a five star hotel).

Origin of Thai Massage
Thai massage originated in India and is based on Ayurveda and yoga, thereafter becoming popular in ancient Siam, now known as Thailand. It was believed that the massage art was brought over to Thailand by Shivago Komarpaj (Jivaka Kumarabhacca), a contemporary of Gautama Buddha over 2500 years ago. The receiver is put into many yoga like positions during the course of the massage. In the northern style based out of Chiang Mai, Thailand there is a lot of stretching movements, unlike the southern style where acupressure is emphasized.

Diagnostic & Treatment
We access client's body during the massage in 2 ways and we modified our treatment according to finding:

1. By palpation through thumb, palm, elbow, experienced therapist can feel the energy flow on Sen lines of human body. Therapist will manipulate the weak or blocked lines to encourage flow of energy and unblock the knots.

2. Therapist will move client's joints in all available range of motions, feel the restriction, or painful feedback. To treat restrictions, therapist will stretch and hold the clients to certain positions, this will bring more mobility to joints and to balance the body.

Therapeutic Relationships
. I shall endeavor to serve the best interests of my clients at all times and to provide the highest quality service possible.
. I shall maintain clear and honest communications with my clients and shall keep client communications confidential.
. I shall acknowledge the limitations of my skills and, when necessary, refer clients to the appropriate qualified health care professional.
. I shall in no way instigate or tolerate any kind of sexual advance while acting in the capacity of a massage and bodywork.

Professionalism
. I shall maintain the highest standards of professional conduct, providing services in an ethical and professional manner in relation to my clientele, business associates, health care professionals, and the general public.
. I shall respect the rights of all ethical practitioners and will cooperate with all health care professionals in a friendly and professional manner.
. I shall refrain from the use of any mind-altering drugs, alcohol, or intoxicants prior to or during professional sessions.
. I shall always dress in a professional manner, proper dress being defined as attire suitable and consistent with accepted business and professional practice.
. I shall not be affiliated with or employed by any business that utilizes any form of sexual suggestiveness or explicit sexuality in its advertising or promotion of services, or in the actual practice of its services.

Scope of Practice / Appropriate Techniques
. I shall provide services within the scope of the IATM definition of Thai massage and bodywork, and the limits of my training. I will not employ those massage, bodywork techniques for which I have not had adequate training and shall represent my education, training, qualifications and abilities honestly.
. I shall be conscious of the intent of the services that I am providing and shall be aware of and practice good judgment regarding the application of massage, bodywork or somatic techniques utilized.
. I shall not perform manipulations or adjustments of the human skeletal structure, diagnose, prescribe or provide any other service, procedure or therapy which requires a license to practice chiropractic, osteopathy, physical therapy, podiatry, orthopedics, psychotherapy, acupuncture, dermatology, cosmetology, or any other profession or branch of medicine unless specifically licensed to do so.
. I shall be thoroughly educated and understand the physiological effects of the specific massage, bodywork, somatic or skin care techniques utilized in order to determine whether such application is contraindicated and/or to determine the most beneficial techniques to apply to a given individual. I shall not apply massage and bodywork techniques in those cases where they may be contraindicated without a written referral from the client's primary care provider.

Image / Advertising Claims
. I shall strive to project a professional image for myself, my business or place of employment, and the profession in general.
. I shall actively participate in educating the public regarding the actual benefits of Thai massage & bodywork.

I shall practice honesty in advertising, promote my services ethically and in good taste, and practice and/or advertise only those techniques for which I have received adequate training and/or certification. Filing a Complaint

A complaint must be received by the Registrar in writing, recorded on audio tape or on video, submitted on disk or on other permanent medium. The complaint should include: the name of the therapist, the time, place, date(s) and details of the event(s). There is no time limitation on filing a complaint with us.

For your assistance we have developed a complaints form that you may wish to use. This template has been developed to ensure that all necessary information is included in your letter of complaint.

Once a Complaint Has Been Received

After ensuring that all the required information has been received, the Registrar contacts the complainant in writing to confirm receipt of the complaint and notifies the Complaints Committee that a complaint has been filed. The therapist then receives a copy of the complaint with a request for a written reply within thirty days. The therapist's response will be forwarded to the complainant who will then be given an opportunity for further comment.

Investigating a Complaint

At its discretion, the Committee may appoint an investigator to inquire into the complaint. The investigator may visit the site of the alleged incident(s), interview people who may have pertinent information, or meet separately with both the complainant and the therapist. Following the investigation, a report is compiled and submitted to the Committee. The Committee then reviews the report and the supporting documentation and decides how to proceed.

More Facts About Complaints

-The Complaints Committee is comprised of both public and professional members of the Council.

-The Committee is only responsible for determining whether the massage therapist's services were professionally and competently rendered. The Complaints Committee has no authority to assess injury, demand refunds from the therapist or award damages to complainant.

-The College will not process anonymous complaints as the certified thai massage practitioner who is the subject of the complaint must be in a position to respond fully to the allegation or allegations contained in the complaint.

-Unlike the results of the disciplinary hearing, which become a matter of public record, all information relating to the investigation and resolution of complaints is held in the strictest of confidence.

The Decision

The Committee may do one or more of the following
in response to a complaint:

-dismiss the complaint, giving reasons in writing, if the massage therapist's conduct and actions meet acceptable standards of practice;

-refer the case to the Discipline Committee for action if there are sufficient grounds for a charge of professional misconduct or incompetence or both;

-refer the case to the Executive Committee for further action if there is sufficient evidence to suggest physical or mental incapacity; and/or

-take action that it considers appropriate which is consistent with the Regulated Health Profession Act, 1991 such as issuing a verbal caution

Both the complainant and the certified thai massage practitioner receive a written copy of the decision. Either party has the right to appeal the decision within 30 days.

Disciplinary Process

Once a Complaints File has been transferred to the Discipline Committee, it shall be given priority and within 14 days a Discipline Hearing shall be scheduled. Such hearing to commence within 60 days of the date the file has been transferred.

1. With the consent previously received from the Complainant, the Committee may examine any confidential information and/or medical records of the Complainant related to the alleged offense.

2. Upon a matter being referred to the Discipline Committee, the Discipline Committee shall consider the written submissions of the Member and Complainant and all records and documents it considers relevant to the complaint.

Discipline Hearing Procedure

1. When a matter is referred to the Discipline Committee for a hearing, the Chairperson shall inform both the Complainant and the Member of the following by registered mail, no later than 21 days prior to the date of the hearing:
1) That a hearing has been deemed necessary
2) A list of the allegation(s) to be heard.
3) That both parties have the right to be heard in person.
4) That each party may be represented by legal counsel at their own expense.
5) That each party may also be accompanied by any other person of the general public, or a IATM member in good standing.
6) Provided with a copy of the Complaints/Complaints and Discipline Committee Policies and Procedures.
7) Invited to provide written submissions within 14 days of any additional information or arguments relevant to the deliberation of the Committee.
8) Request that both parties must confirm their attendance or non-attendance for the hearing, at least 7 days prior to the date of the hearing.
9) In the event of financial incapacity of the member to attend the hearing in person, the member may apply to the Board of Directors for remuneration inline with current Travel and Expenses policies.

2. On the day of the hearing, when necessary, the Discipline Committee, the Complainant or his/her legal representative and the Member or his/her legal representative, has full right to:
1) Examine, cross-examine and re-examine all witness testimony.
2) In cases where there is a reasonable belief by the Discipline Committee that either party would suffer emotionally from a face-to-face meeting, the testimonies at the hearing may be done by teleconference or as separate in-person interviews.
3) Present evidence in defence and reply.

3. When a Member fails to attend the hearing, the Discipline Committee may proceed in his or her absence.

4. When the Complainant fails to attend the hearing and does not provide a just reason, the Discipline Committee may interpret this as a lack of commitment, and may have cause to dismiss the complaint.

5. If, during the course of a hearing, the evidence shows that the member may be guilty of misconduct different from, or in addition to, any misconduct specified in the allegation, the Discipline Committee shall adjourn the hearing for any period that the Committee considers sufficient. This is to give the Member an opportunity to prepare a defence to the amended allegation(s), unless the Member consents to continue the hearing.

6. The Discipline Committee is not bound by the formal rules of evidence applicable to court proceedings and may accept any evidence that it considers to be admissible and relevant.

7. The Discipline Committee may consider the written report of the Complaints Committee in whole or in part, or may call the Complaints Committee as a witness to present the report.

8. The Discipline committee may conduct the hearing or any part of the hearing in camera.

9. The deliberations of the Discipline Committee shall be conducted in private. No person who is not a member of the Committee shall be present.

10. The Discipline Committee shall give the findings of the hearing and provide reasons for its decisions and for any sanction ordered. This hearing report shall be sent within 14 days to the Board of Directors for their immediate action.

11. Copies of the hearing report shall be provided to both the Complainant and the Member.

12. The Discipline Committee shall advise the Member of any rights to request an appeal.

13. Upon a referral the Discipline Committee may suspend the membership of the Member pending the outcome of a hearing before the Discipline Committee.

Conflict of Interest or Bias

1. In the event that any Member of a Complaints, Discipline or Appeal Committee has a conflict of interest or is biased, that person shall declare the conflict or bias and the Chairperson of that committee shall appoint, upon Board approval, a replacement.

2. In the event of a conflict of interest on the part of a Board Member, that Director shall not participate in any discussion or action of the Board related to this file.

3. No Director shall participate in the hearing of an appeal if:
1) the Director has a conflict of interest or is biased;
2) there is any reasonable basis on which it may appear that the Director may have a conflict of interest or may be biased;
3) any Director’s participation in the process prior to the hearing of the appeal that is deemed to create the appearance of a bias.

Reinstatement

1. Reinstatement of membership is pursuant to IATM Bylaws.

Dispersal of Evidence

1. All original documents and items put into evidence at the hearing shall be returned by the Discipline Committee to the person who produced them within 28 days after the hearing has concluded.
